1. Agreement
By installing AccessifyAI from the Shopify App Store and clicking Install you agree to these Terms of Service and to our Privacy Policy. AccessifyAI is provided by Ensomedia (sole proprietorship, Poland), referred to below as "we".
2. The service
AccessifyAI is an automated accessibility-testing tool for Shopify storefronts. It scans public storefront HTML against WCAG 2.2 Level A and AA criteria, presents findings in the merchant admin UI, and (on paid plans) generates AI-assisted fix suggestions.
What the service is not: AccessifyAI is not a legal accreditation body, a law firm, or a guarantee of compliance with the ADA, EAA, or any other accessibility regulation. The service produces automated test output that supports a merchant's accessibility-improvement work; it does not certify that a website is legally accessible. Always consult a qualified accessibility professional and a lawyer in your jurisdiction.
3. Plans and billing
Plans (Free, Basic, Pro) and prices are shown in the upgrade page of the app and are billed through Shopify's App Subscription system. By subscribing you authorise Shopify to charge the payment method on file with your Shopify account at the listed price plus any applicable taxes.
Trials: paid plans include a 14-day no-charge trial. After the trial ends Shopify will automatically charge the listed monthly price unless you cancel. Cancellation is available at any time from your Shopify admin under Settings > Apps and sales channels > AccessifyAI.
Promotional codes (e.g. launch discounts) reduce the price for a defined number of billing cycles. After the discount period the subscription returns to the standard list price; we will request re-confirmation through Shopify Billing before any price change takes effect.
Refunds: AccessifyAI does not provide refunds for partial billing cycles. If you believe you have been incorrectly charged, contact contact@ensomedia.pl within 30 days and we will review in good faith.
4. Acceptable use
You agree not to:
- Use AccessifyAI to scan storefronts you do not own or have explicit permission to test.
- Attempt to reverse-engineer, decompile, or extract source code from the service or its storefront widget.
- Submit content through the AI tools that contains personal data of identifiable individuals you do not have a lawful basis to process.
- Re-sell access to AccessifyAI without a written reseller agreement with us.
Agency use is permitted: a developer or agency installing the app on a client's store on the client's behalf is a normal and supported workflow.
5. Service limits and rate limiting
Each plan tier has documented limits (pages per scan, AI tokens per month, scan schedules). We reserve the right to apply soft-limits or temporary throttling to protect service stability. Excessive abuse may result in account suspension. We will notify you before suspending a paying account.
6. Storefront widget
The optional storefront widget (Pro feature) is loaded on your public storefront. By enabling it you authorise AccessifyAI to serve a small JavaScript bundle and a CSS stylesheet from our domain, and to receive widget-configuration requests from your storefront. The widget does not transmit end-customer personal data — see the Privacy Policy for details.
7. Intellectual property
AccessifyAI's code, scanner rules, AI prompts, and brand belong to Ensomedia. AI-generated alt text, fix suggestions, and accessibility statements are made available to you for use on your storefront under a non-exclusive licence; you remain responsible for reviewing and approving any changes before applying them.
8. Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSIFYAI IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR REVENUE ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THAT PERIOD.
Nothing in these terms excludes liability for death, personal injury, fraud, or any other liability that cannot be excluded under applicable law.
9. Termination
You can uninstall AccessifyAI at any time from your Shopify admin. Termination ends your right to use the service. We will delete your data 30 days after uninstall as described in the Privacy Policy. We may suspend or terminate accounts that violate these Terms or that present a risk to other merchants or to Shopify.
10. Governing law
These Terms are governed by the laws of Poland. Disputes will be resolved in the courts of competent jurisdiction in Poland, without prejudice to your statutory consumer rights in your country of residence.
